The Terms and conditions contained on this page is a part of an agreement between Biz Solar ABN 36 621 350 490 and the customer named on the Quote/contract referred as “you” or “your”.
1. ACCEPTENCE: This agreement starts when you accept our offer set out in this quote, which you can do by sending an email or signing, scanning and sending the quote to our address by post or by email. You may also require to pay the deposit amount to make your purchase final.
2. YOU WARRANT THAT YOU : a) are at least 18 years of age; and b) either a registered property owner or c)you have been authorized by all registered owners to enter into this agreement; d) have read and accepts the provisions of this agreement.
3. PAYMENT: a) Payments under this agreement can be made by bank cheque, money order, cash, debit card, credit card or direct deposit.
b) Required deposit must be paid in full at the same time as you accept our offer.
c) You must pay Biz Solar the balance at the same time as Biz Solar delivers the system to the premises
d. Title & ownership of the solar system will transfer to you only upon installation & Biz Solar receiving full payment from you for the solar system.
e. If you fail to pay any amount that is due & payable under this agreement, Biz Solar will be entitled to charge interest on the unpaid amount at the current Reserve Bank target cash rate plus 2%. You will also have to pay Biz Solar any costs associated with the recovery of such unpaid amounts.
f. Failure to pay the complete amount may result in Biz Soar taking legal action against you & will void all warranties offered in conjunction with this system & installation.
4. REPOSSESSION AND COSTS: Notwithstanding clause 3, if payment is not received by Biz Solar when due, Biz Solar reserves the right to enter the installation address without notice and repossess the System and to seek from you all costs for the repossession, loss in value of the repossessed system, wasted costs including but not limited to handling, installation and disbursements.
5. PRICE CHANGES: If it is reasonable to do so and are not prohibited by law from doing so; In effect of the price increase of the system or any part of it, the installation of the system, STC value increase or decrease and any item mentioned in this quote Biz Solar will notify you about this price changes to cover the cost by information provided by you in this quotation.
6. REFUNDS: This agreement ends for any of the following reasons before we install a system at your premises and we will refund all of the money you have paid under this agreement. a) within 10 days after accepting this agreement b) if the price increase notice is given and you chose to end the agreement rather than accepts the price increase; and c) if the distributor refuses the grid connection application.
7. GRID CONNECTION APPROVAL: Biz Solar will apply for grid connection approval on your behalf as soon as we receive required information from you. This agreement is subject to grid connection approval being granted. Installation target day may change due to delays in installation.
8. DELIVERY AND INSTALLATION: 1) Biz Solar will make every reasonable effort to ensure that your System is delivered and installed on the agreed date provided condition 1 met. 2) You agree that the agreed date is only a target date and not a strict deadline and Biz Solar will not be liable to you if we fail to deliver and install the System at the Installation Address by the agreed date. 3) Subject to the provisions in this Agreement you may indicate your preference as to the location of the solar panels and inverter but you must do as soon as possible before the commencement of any work. 4) Installation is to take place in accordance with the design and specification provided by Biz Solar unless circumstances that could not have been reasonably anticipated by Biz Solar require a new design or specification which may result in a change in the Price. You or your representative must be present at the Premises for any site inspection and for the delivery and installation of the System.
9. BUILDING DEFECTS: a) You warrant that the building or location at the Installation Address is safe, free from defects including asbestos-free and fit for the purpose of installing the System. B) You acknowledge that Biz Solar is not responsible for any damage to the System or your building howsoever so caused as a consequence of a defect or deficiency in your building or part thereof. C) Biz Solar is not responsible or liable for diminished or inadequate performance or installation if your building contains brittle roof tiles, oxidized metal roof or meter boxes or poor roof supports. d) You must fix all such defects before Biz Solar arranges for the installation of the System.
10. SITE ACCESS: The Purchaser grants to Biz Solar permission, sufficient access or possession of the Site as is necessary to complete site inspections, delivery and the installation of the goods. Any failure to provide access or impede that access, such that the installation works cannot be conducted by Biz Solar may result in a change in the Price.
11. ACCREDITED INSTALLER: To ensure your system meets industry best practice and all relevant Australian Standards we contract a Clean Energy Council accredited independent license electrician (“Installer”) to install your system who is responsible for installing your system. We agree to provide you with details of your Installer prior to the commencement of any work upon request.
12. STCs a) You agree to pay Biz Solar the STC’s for the installation as part-payment for your system. The STC’s will be paid directly to Biz Solar. If the Office of Clean Energy Regulator (http://www.cleanenergyregulator.gov.au) determines you are not eligible to receive STC’s, & therefore Biz Solar is unable to receive the STC’s, you will be liable to pay Biz Solar the value of the STC’s as determined by market rates.
b. if you are not eligible for STC’s, or if you wish to claim the STC’s yourself, you must notify Biz Solar in writing & the complete payment for the system (including trading costs of the STC’s) is due prior to installation.
c. You acknowledge that if you breach any conditions of the STC Regulations, you may be financially liable to the Office of Clean Energy Regulator. If you commit any breach of the STC Regulations, you acknowledge that Biz Solar will not be liable to you or the Office of Clean Energy Regulator on your behalf.
d. Biz Solar, will arrange for the complete documentation & processing of the sale of the STC’s. You acknowledge that the price of STC’s is governed by market movements & the Renewable Energy Certificates (REC’s) guidelines. If the market price of STC’s falls below a certain point, as determined by Biz Solar at its absolute discretion, Biz Solar may decide to delay the installation until the price rises, or cancel your installation & refund your complete deposit.
13. SYSTEM GUARANTEES: Providing that reasonable inspection of the goods has not resulted in the detection of any defect in the goods and subject to sub-clause 13.B hereof, liability for breach of any conditions or warranty implied by the Australian Consumer Law is limited to any of the following as determined by Biz Solar (i) the replacement of the goods or the supply of equivalent goods; (ii) the repair of the goods.
13.B The only conditions and warranties which are binding on Biz Solar in respect of the stated, quality, capability or condition of the goods or whether they are suitable, adequate or appropriate for the purpose or purposes for which they are purchased or anything else in relation to the goods are those provisions which cannot be excluded under any Federal or State law relating to the sale or supply of goods C) The foregoing warranty does not apply to the System if: (i) the System has been modified by any party other than us, or without our prior written consent; (ii) the System has been improperly installed by you or installed by anyone other than a Clean Energy Council accredited independent License electrician; or (iii) an Outstanding Amount remains unpaid for 10 days or more. d) For the avoidance of doubt, when an Outstanding Amount remains unpaid to Biz Solar then all call-outs for maintenance, service and repairs remain suspended until the Outstanding Amount is received in full by Biz Solar. E) Although these other guarantees and warranties may not cover labor costs, travel costs and delivery costs arising from a claim under these other guarantees and warranties. We will notify you if this is the case, and tell you the costs payable. The costs will be payable in advance. F) Biz Solar offers a system warranty of 1 year or as agreed in this agreement, solar components manufacturer’s warranty applies as per manufacturer’s warranty terms. G) During the warranty Period, we will provide reasonable assistance to you in making any guarantee or warranty claim against the manufacturer of the System, including by acting as your liaison with the manufacturer.
14. MAKING A COMPLAINT : If you have a complaint relating to the System, its installation or this agreement generally, you can make a complaint to us by: (a) calling us on our telephone number as set out in the Quote; or (b) giving us written notice of this, by post or email.
15. PRIVACY: We will comply with all relevant privacy legislation in relation to your personal information. Copy of our privacy policy available on www.bizsolar.com.au
a. You agree to provide Biz Solar with whatever personal information is required for the efficient functioning of Biz Solar on your behalf, in particular with relation to the processing of STC’s & your Grid Connection.
b. Biz Solar will only provide your information to its contractors, employees, & installers as is required to effectively perform the required work.
c Biz Solar will only provide your information, on your behalf, to the relevant bodies (for the processing the STC’s), & the Electricity Distributor & Retailer (for connecting your Solar PV System to the grid).
d. Unless otherwise stated & agreed upon, Biz Solar will not provide your personal information to any third parties other than those mentioned above.
e. On the day of installation you must sign all necessary documents as is required for the fulfilment of all parties’ obligations under this agreement.
f. Biz Solar will not sell your personal information under any circumstances.
16. Liabilities and Risk: a. Biz Solar accepts no responsibility for insurance or insurance risk of the solar system upon installation. It is your responsibility to ensure that your property insurance adequately covers your Solar PV System.
b. You acknowledge Biz Solar accepts no liability or responsibility for your Feed-in-Tariff (FiT), as administered by the relevant Government body.
c. Biz Solar accepts no responsibility for any damage or loss caused to your property by the installer which has not been caused by the installer’s negligence. All Biz Solar’s installers are contractors who are required by Biz Solar & the relevant legislation’s to have appropriate third party insurance including damage insurance. Biz Solar will work with you & the installer to rectify any damage caused to your property as a result of installer negligence.
d. You acknowledge that Biz Solar will not be responsible for any damage caused to old & brittle roofing tiles that may be cracked or damaged during installation.
e. Unless otherwise stated, Biz Solar accepts no responsibility or liability for additional costs or delays in relation to your need to obtain an upgrade of your meter box, sub-board, or the installation of a new meter; the removal & handling of asbestos at your property in relation to the installation of the Solar PV System; or the installation of timers, contactors, switches, or other wiring & work in relation to Electric Hot Water, Slab Heating, Climate Saver, or OffPeak meters.
f. Biz Solar accepts no responsibility or liability for delays in installation if any information provided by the customer is incorrect.
17. Net Meter: Grid (NET) Meter to be installed by your Electricity Retailers and not included in quotation
18 Meters: a. In the event that the meter box is located remotely from the inverter installation location, & such costs are not provided for in the relevant Biz Solar quotation, the customer will be required to arrange & pay for the additional work.
b. Biz Solar’s quote does not include additional costs in relation to reconfiguration of your meter as part of the Grid Connection Process which comes from your Power Distributor or Electricity Retailer.
